Business Operations: Privacy / Data Protection

Identity theft and security breaches have caused millions of dollars in losses, according to the US Federal Trade Commission. Such disclosures have heightened global public awareness of the risks of identity theft and other potential abuses from any unauthorized access to sensitive personal information. Such risks apply all businesses, which now must develop and maintain compliance policies for privacy of sensitive personal information (SPI), personally identifiable information (PII) or personal health information (PHI), depending on the applicable law. Compliance is no longer an option, but a way of life, to preserve goodwill, maintain eligibility to participate in a “chain of trust,” avoid liability and litigation and enhance competitive position.

We advise on existing and anticipated legislation that calls for administrative, technical, and physical safeguards for the protection of sensitive personally identifying information, as well as on state and federal mandates governing the disclosure of security breaches that may involve the loss, theft or misappropriation of SPI / PII or PHI. California law creates a direct personal cause of action by the affected California residents. We assist clients in dealing with personal data privacy, data security, cyber-security and identity theft.

Foreign laws (such as Canada’s Personal Information Privacy and Electronic Data Act, or PIPEDA, and the European Data Protection Directive and enabling national legislation in member states) are even more comprehensive on cradle-to-grave protection of privacy data, disclosure on intended uses, limitation on gathering of PII to meet only the minimum requirements, opt-in requirements and other rights. We collaborate with foreign law firms to help clients get a global picture, develop privacy policies, and plan incident responses.
